Član 12. Upis objekta
Prodavac se obavezuje da pribavi upotrebnu dozvolu za objekat, i da izvrši upis objekta u katastar nepokretnosti, da izvrši pravnu podelu objekta na posebne delove i da ih upiše u katastar nepokretnosti. Kupac potvrđuje da je upoznat da ispunjenje navedenih obaveza Prodavca zavisi od kapaciteta i efikasnosti nadležnih organa i saglasan je da neće Prodavca smatrati odgovornim za bilo koje kašnjenje u završetku navedenih radnji.
Prodavac nije odgovoran za upis prava svojine Kupca nad Nepokretnošću u katastaru nepokretnosti.
Ako je neophodno, nakon izdavanja upotrebne dozvole i upisa objekta i posebnih delova u katastar nepokretnosti, Ugovorne strane će zaključiti aneks ovog Ugovora sa ciljem preciznog definisanja identifikacionih obeležja Nepokretnosti, a kako bi se olakšao njen upis u katastar nepokretnosti.
Kupac snosi sve troškove upisa njegovog prava svojine nad Nepokretnošću u katastar nepokretnosti.
第十二条 不动产登记
卖方有义务取得建筑物的使用许可证,并将该建筑物登记于不动产登记机构,同时依法将建筑物划分为专有部分,并分别予以登记。买方确认,其已知悉卖方上述义务的履行取决于主管机关的效率及处理能力,并同意卖方对完成上述手续的任何延误不承担责任。
卖方不对买方在不动产登记机构办理该不动产所有权登记承担责任。
如有必要,在取得使用许可证并完成建筑物及其专有部分在不动产登记机构的登记后,合同双方应签署本合同的补充协议,以明确不动产的具体识别信息,从而便于其登记。
买方应承担其不动产所有权在不动产登记机构登记的全部费用。
